يفصل رئيس المحكمة البدائية على وجه الاستعجال بأمر مبلغ الكفالة المطلوب تأديته من قبل
مالك السفينة ليتمكن من التفرع
بحصر المسئولية لمالك السفينة في كل وقت ان يوقف عن نفسه الملاحقات بايداعه المبلغ
الذي يتسع له مدى مسئوليته.
والمبلغ المودع يحدد بسعر القطع يوم الدفع وهو معد لابقاء حقوق الدائنين الذين يسري عليهم
حصر المسئولية.
يجري التوزيع على الدائنين وفقاً للقوانين السارية المفعول.
