لا يجوز للربان تحت طائلة بطلان البيع ان يبيع السفينة بدون تفويض خاص من صاحبها الا اذا ثبت
قانونا وحسب الاصول ان
السفينة غير صالحة للملاحة.
وعند عدم وجود تفويض او تعليمات خاصة من صاحب السفينة يجري البيع بطريقة المزايدة
العلنية متى ثبت عجز السفينة عن
الملاحة كما هو مبين اعلاه.
