لا يكون الضرر والهلاك الناتجان عن عيب خاص في الشيء المؤمن على عاتق المؤمن الا اذا
اشترط العكس ما لم يكن التأمين
على جرم السفينة وكان في السفينة عيب خفي لم يكن بمقدور مجهزها ان يقدره و لا ان
يمنعه.
