لا يحول الحكم الذي يجيز للمؤمن ان يقدم الدليل على وقائع تخالف الوقائع المدونة في الاوراق
الثبوتية دون الحكم عليه
بالدفع المؤقت للتعويضات المتوجبة عليه بشرط ان يقدم المؤمن له كفيلا.
يسقط تعهد الكفيل بعد انقضاء سنتين في حالة عدم الملاحقة.
وكذلك في حالة وقوع التسوية بواسطة الترك.
