يمكن عقد الرهن البحري على سفينة قيد الانشاء وفي هذه الحالة يجب ان يسبق الرهن تصريح
موجه لمدير عام الميناء.
ويبين في هذا التصريح طول ابريم السفينة وسائر اقيستها على وجه التقريب ومحمولها المقدر
ويذكر فيه ايضاً مكان انشائها.
