1 - اذا كانت المحكمة مؤلفة من قاض فرد فيقوم بنفسه بوظائف القاضي المنتدب.
2 . - ويحق له ان يعهد بالوظائف المذكورة كلا او بعضا الى احد قضاة الصلح في منطقته
