لا يوقف الطعن ببطلان الاندماج استمرار العمل به إلى أن يصدر قرار قضائي قطعي بالبطلان
ويجوز للمحكمة عند النظر في
دعوى البطلان أن تحدد من تلقاء ذاتها مهلة لاتخاذ اجراءات معينة لتصحيح الأسباب التي أدت
إلى الطعن بالبطلان ، ولها
رد الدعوى بطلب البطلان إذا قامت الجهة المعنية بتصحيح الأوضاع قبل النطق بالحكم.
