اذا كانت تصفية شركة التضامن اختيارية باتفاق جميع الشركاء فيعين المصفي وتحدد أجوره
من قبلهم ، فاذا اختلفوا على
ذلك فيتم تعيين المصفي وتحديد أجوره من قبل المحكمة بناء على طلب الشركاء او اي منهم
، واما اذا كانت الشركة قد انقضت
بحكم القانون او بقرار قضائي فيتم تعيين المصفي وتحديد أجوره من قبل المحكمة.
