أ-تطبق الأحكام المنصوص عليها في هذا النظام والمتعلقة بأحكام واجراءات استرداد الأراضي
وتقدير التعويض وكيفية صرفه وأسس تحديد أتعاب الخبراء على استرداد المطور الرئيسي
للأراضي التي انتقلت ملكيتها للمؤسسة المسجلة.
ب- تشكل لجنة تقدير التعويض في هذه الحالة برئاسة خبير تعينه الوزارة وعضوية خبير يعينه
المطور الرئيسي وخبير تعينه المؤسسة المسجلة على أن يتحمل كل من المطور الرئيسي
والمؤسسة المسجلة أتعاب الخبير الذي يعينه ويتحمل كل من المطور الرئيسي والمؤسسة
المسجلة أتعاب الخبير الذي تعينه الوزارة مناصفة .
