ليس للمالك ان يشترط في تصرفه عقدا كان او وصية شروطا تقيد حقوق المتصرف اليه الا اذا
كانت هذه الشروط
مشروعة وقصد بها حماية مصلحة مشروعة للمتصرف او المتصرف اليه او الغير لمدة محدودة.
