لا يجوز للدائنين الذين لم يستوفوا حقوقهم لعدم ثبوتها في بيان "وصي التركة " ولم تكن لهم
تأمينات على
اموال التركة ان يرجعوا على من كسب بحسن نية حقاً عينياً على تلك الاموال ولهم الرجوع على
الورثة في حدود ما عاد عليهم
من التركة.
