اذا اشترى شخص عينا تجوز الشفعة فيها ثم باعها من اخر قبل اخذها بالشفعة فللشفيع اخذها
بالثمن الذي قام
على المشتري الاول وللمشتري الثاني ان يسترد الفرق من المشتري الاول ان وجد.
