Article text
لا تسمع دعوى الشفعة:-
1 - اذا تم البيع بالمزاد العلني وفقا لاجراءات رسمها القانون.
2 - اذا وقع البيع بين الاصول والفروع او بين الزوجين او بين الاقارب حتى الدرجة الرابعة او بين
الاصهار حتى الدرجة
الثانية.
3 - اذا نزل الشفيع عن حقه في الشفعة صراحة او دلالة.
