اذا انقضى الاجل المحدد للانتفاع او مات المنتفع في اثنائه وكانت الارض المنتفع بها مشغولة
بزرعه تركت
الارض للمنتفع او ورثته باجر المثل حتى يدرك الزرع ويحصد ما لم ينص القانون على غير ذلك.
