1 - تعتبر القيود المفروضة على حق مالك العقارات في البناء حقوقا مجردة على هذه العقارات
لفائدة العقارات
التي فرضت لمصلحتها ما لم يتفق على غير ذلك.
2 - وكل تجاوز لهذه القيود يستوجب المطالبة باصلاحه عينا او بالتضمين اذا ثبت موجبه.
