1 - لا يجوز للعدل ان يسلم المرهون للراهن او المرتهن دون رضا الاخر ما دام الدين قائماً وله ان
يسترده
اذا كان قد سلمه.
2 - واذا تلف المرهون قبل الاسترداد ضمن العدل قيمته.
