1 - لا يكون رهن الدين نافذا في حق المدين او قبل الغير الا اذا اعلن هذا الرهن رسميا الى المدين او
رضي
به.
2 - ولا يكون نافذا في حق الغير الا بحيازة المرتهن لسند الدين المرهون ، وتحسب للرهن مرتبته
من التاريخ الثابت للاعلان
او القبول.
