Article text
1 - يضاف الفعل الى الفاعل لا الامر ما لم يكن مجبرا على ان الاجبار المعتبر في التصرفات
الفعلية هو الاكراه
الملجىء وحده.
2 - ومع ذلك لا يكون الموظف العام مسؤولا عن عمله الذي أضر بالغير اذا قام به تنفيذا لامر صدر
اليه من رئيسه متى كانت
اطاعة هذا الامر واجبة عليه او كان يعتقد انها واجبة واقام الدليل على اعتقاده بمشروعية العمل
الذي وقع منه وكان اعتقاده
مبنيا على أسباب معقولة وانه راعى في عمله جانب الحيطة والحذر.
