1 - يجب في التصرف التخييري تحديد مدة الاختيار.
2 - فاذا لم يحدد المتعاقدان مدة في العقد او انقضت المدة المحددة لاحدهما دون ان يختار جاز
للطرف الاخر ان يطلب من
المحكمة تحديد مدة الخيار او محل التصرف.
