1 - اذا اتفق في العقد على ان احد الشركاء لا يفيد من ارباح الشركة ولا يساهم في خسائرها كان
عقد الشركة
باطلا.
2 - غير انه يجوز الاتفاق على اعفاء الشريك الذي لم يقدم غير عمله من المساهمة في الخسائر
بشرط ان لا يكون قد تقرر
له اجر عن عمله.
