Article 625 of Civil Code No. 43 of 1976
Article text
1 - اذا كان عقد المضاربة مطلقا اعتبر المضارب مأذونا بالعمل والتصرف برأس المال في شؤون
المضاربة وما يتفرع
عنها وفقا للعرف السائد في هذا الشأن.
2 - واذا قيد رب المال المضاربة بشرط مفيد وجب على المضارب مراعاته فاذا تجاوز في تصرفه
الحدود المأذون بها فله الربح
وعليه الخسارة وما أصاب رأس المال من تلف مع ضمان الضرر الذي ينجم عن مثل هذا التصرف.
