الباب الخامس
الدفوع والطلبات
الفصل الأول
الدفوع
1 - للخصم قبل التعرض لموضوع الدعوى أن يطلب من المحكمة إصدار الحكم بأي من الدفوع
التالية شريطة أن يقدم جميع ما يرغب بإثارته منها في طلب واحد مستقل خلال المدد
( المنصوص عليها في المادتين 59 ) ( و 60 ) من هذا القانون:-
أ- . عدم الاختصاص المكاني
ب- . وجود شرط أو اتفاق تحكيم
ج- . مرور الزمن
د- . بطلان تبليغ أوراق الدعوى
2 - على المحكمة أن تفصل في الطلبات المشار إليها في البنود (أ) و(ب) و(د) من الفقرة
السابقة، ولها أن تفصل في الطلب المشار إليه في البند (ج) من تلك الفقرة أو أن تقرر ضم َّه إلى
الموضوع.
