إذا لم تكن هناك وظيفة شاغرة من الفئة والدرجة التي يستحقها المرشح للتعيين بموجب
أحكام هذا النظام فيجوز تعيينه على حساب وظيفة
شاغرة ذات درجة أعلى أو أدنى مباشرة من الدرجة التي يستحقها من الفئة ذاتها ويتقاضى راتبه
الاساسي من مخصصات هذه الدرجة على أن
يعدل وضعه بقرار من الوزير في أول وظيفة تشغر بالدرجة التي يستحقها أو بإدراجها له في أول
نظام يصدر لتشكيلات الوظائف وتعتبر أقدميته في الدرجة في أي من الحالتين اعتباراً من تاريخ
تعيينه في الوظيفة.
