Article text
أ- يسقط حق الأفضلية في حال عرض الشريك، الذي ينوي
بيع حصته، على شركائه شراءها بإخطار موجه بوساطة
الكاتب العدل يتضمن اسم المشتري، وعنوانه، والثمن
المتفق عليه، وشروط البيع، ولم يقبل أي منهم شراءها
بالثمن والشروط المذكورة خلال ( 10 ) عشرة أيام من تاريخ
تبلغهم الإخطار .
حق الأفضلية لا يقبل التجزئة، فليس لصاحبه أن يأخذ
ب- إذا قبل أي من الشركاء شراء الحصة بالثمن والشروط
المذكورة في الإخطار فعليه تبليغ الشريك الذي ينوي
البيع، بوساطة الكاتب العدل، إخطاراً بقبوله الشراء، على
أن تستكمل معاملة البيع لدى مديرية التسجيل خلال
عشرة أيام من تاريخ تبلغ الشريك إخطار قبول الشراء.
