Article text
أ- يجري تنفيذ سند الرهن لدى دائرة التنفيذ المختصة التي
تتولى مباشرة إجراءات تنفيذ السند وبيع العقار المرهون
تأميناً للدين بالمزاد العلني طبقاً للإجراءات المنصوص
عليها في قانون التنفيذ .
ب- تستمر مديريات التسجيل في تنفيذ سندات الرهن
التي باشرتها قبل نفاذ أحكام هذا القانون ولم تمض سنة
واحدة على آخر اجراء فيها وفقا للإجراءات المنصوص
عليها في قانون وضع الاموال غير المنقولة تامينا للدين
ويقوم مدير التسجيل مقام رئيس التنفيذ في المعاملات
الجاري تنفيذها .
ج- يسقط حق المحكوم له بتنفيذ الحكم القاضي بإعلان
بطلان اجراءات بيع العقار المرهون بالمزاد العلني إذا لم
ينفذ الحكم خلال ثلاث سنوات من تاريخ اكتسابه الدرجة
القطعية ما لم يوجد عذر شرعي يحول دون تنفيذه.
