Article text
يجوز رد القاضي لأحد الأسباب التالية :-
أ- إذا كان له أو لزوجه دعوى مماثلة للدعوى التي ينظرها أو إذا استجدت لأحدهما خصومة مع احد
الخصوم أو مع زوجه بعد قيام الدعوى المطروحة على القاضي ما لم تكن هذه الدعوى قد
أقيمت بقصد رده عن نظر الدعوى المطروحة عليه .
ب- اذا كان لمطلقته التي له منها ولد أو لأحد أقاربه أو أصهاره على عمود النسب خصومة قائمة
أمام القضاء مع احد الخصوم في الدعوى أو مع زوجه ما لم تكن هذه الخصومة قد أقيمت بعد
قيام الدعوى المطروحة على القاضي بقصد رده .
ج- اذا كان احد الخصوم يعمل لديه .
د- اذا كان يسكن مع احد الخصوم أو كان قد تلقى منه هدية قبيل رفع الدعوى أو بعده.
هـ- اذا كان بينه وبين احد الخصوم عداوة أو صداقة يغلب على الظن معها عدم استطاعته
الحكم بغير ميل .
( و- إذا كان ممنوعاً من نظر الدعوى لأي سبب من الأسباب المنصوص عليها في المادة 125 ) من
هذا القانون.
