Article text
العلة في الزوج التي لا يمكن المقام معها بلا ضرر
( المادة 116 )
اذا ظهر للزوجة قبل الدخول او بعده ان الزوج مبتلى بعلة او مرض لا يمكن الاقامة معه بلا ضرر
كالجذام او البرص او السل
او الزهري او طرأت مثل هذه العلل والامراض فلها ان تراجع القاضي وتطلب التفريق ، والقاضي
بعد الاستعانة بأهل الخبرة
والفن ينظر فان كان لا يوجد امل بالشفاء يحكم بالتفريق بينهما في الحال وان كان يوجد امل
بالشفاء او زوال العلة يؤجل
التفريق سنة واحدة فاذا لم تزل بظرف هذه المدة ولم يرضى الزوج بالطلاق واصرت الزوجة على
طلبها يحكم القاضي بالتفريق
ايضا اما وجود عيب كالعمى والعرج في الزوج فلا يوجب التفريق.
