يحسب التعويض المنصوص عليه في هذا القانون على اساس الاجر الاخير الذي يتقاضاه العامل
اما اذا كان العامل عاملا بالقطعة
فيحسب على اساس متوسط الاجر خلال الاشهر الستة الاخيرة من عمله.
