أ- للمتضرر مطالبة شركة التأمين مباشرة بالتعويض عن الأضرار التي لحقت به وفقاً لأحكام هذا
النظام والتعليمات الصادرة بمقتضاه ولا تسري بحقه الدفوع التي يحق لشركة التأمين التمسك
بها تجاه المؤمن له.
ب- يعتبر المؤمن له وسائق المركبة المتسببة بالحادث مسؤولين بالتضامن عن أي مبالغ
تعويض يحكم بها تزيد على حدود مسؤولية شركة التأمين المقررة بمقتضى أحكام هذا
النظام.
