Article text
أ- في الحالات التي يشترط فيها هذا القانون إشعار الدائنين يجب إشعار الدائنين الأجانب الذين
ظهرت ديونهم في سجلات المدين بوجود إجراءات إعسار بموجب أحكام هذا القانون ويوجه
الإشعار أيضا للدائنين المعلومين والذين ليس لهم عنوان في المملكة و للمحكمة أن تأمر
باتخاذ الخطوات اللازمة لغايات تبليغ الدائنين الذين ليست لهم عناوين معروفة.
ب- يوجه الإشعار لكل من الدائنين الأجانب المُشار اليهم في الفقرة (أ) من هذه المادة على حدة
ما لم تقرر المحكمة توجيه الإشعارات بشكل آخر و يجوز أن يوجه الإشعار للدائنين الأجانب
المعلومين عن طريق الإعلان في الصحف الأجنبية التي يرى وكيل الإعسار أنها الأنسب لضمان
وصولها لعلم الدائنين المعلومين دون حاجة لتوجيه كتب رسمية لهم.
ج- يجب أن يتضمن إشعار إشهار الإعسار الموجه للدائنين الأجانب ما يلي:-
1 - مهلة زمنية معقولة للتقدم بالمطالبات ومكان تقديمها.
2 . - بيانا عما إذا كان على الدائنين اصحاب الحقوق المضمونة التقدم بمطالباتهم
3 - أي معلومات أخرى يجب تضمينها في هذا الاشعار وفقا لأحكام هذا القانون أو ترى المحكمة
