يقسم الدائنون لغايات هذا القانون إلى:-
أ- دائني الإعسار وهم الدائنون الذين نشأت ديونهم في ذمة المدين قبل تاريخ إشهار الإعسار وتم
تضمينها في قائمة الدائنين .
ب - دائنين في مواجهة إجراءات الإعسار وهم الدائنون الذين نشأت ديونهم بعد تاريخ إشهار
الإعسار.
