Article text
أ- تشكل لجنة الدائنين من فئات دائني الإعسار كافة وعلى النحو التالي:-
دائن واحد على الأقل من الدائنين أصحاب الديون الممتازة.
دائن واحد على الأقل من أصحاب الديون غير المضمونة.
3 - يجوز تعيين أصحاب الحقوق المضمونة في لجنة الدائنين شريطة أن لا يشكلوا أغلبية
. الأصوات فيها
4 - أحد العاملين لدى المدين اذا تجاوز عددهم العشرين شريطة عدم احقيته في التصويت على
. المسائل التي تناقشها اللجنة
ب- تتولى لجنة الدائنين المهام التالية:-
الرقابة على عمل وكيل الإعسار ومراقبة سير إجراءات الإعسار.
تقديم المشورة الى وكيل الإعسار بخصوص المسائل المتعلقة بإجراءات الإعسار من تلقاء
ذاتها أو بطلب من وكيل الإعسار.
إقامة الدعاوى واتخاذ الإجراءات التحفظية لضمان حسن إدارة أموال الإعسار والتصرف فيها أثناء
إجراءات الإعسار.
مراجعة المحكمة بخصوص أي مسألة تتعلق بعمل وكيل الإعسار.
. تقديم أي اعتراض او استئناف نيابة عن الدائنين
ج- على وكيل الإعسار أن يسمح للجنة الدائنين بالاطلاع على الوثائق اللازمة وأن يزودها
بالإيضاحات الكافية لتمكينها من أداء مهامها.
د- للمحكمة بتنسيب من وكيل الإعسار تعويض أعضاء لجنة الدائنين عن النفقات التي
تكبدوها .
