Article text
مع مراعاة الأحكام المنصوص عليها في الفصل السابع من هذا القانون، تقسم إجراءات الإعسار
الى المراحل التاليــــــــة:-
أ- المرحلة التمهيدية و تبدأ من تاريخ صدور قرار المحكمة بإشهار الإعسار وتخصص لحصر ذمة
الإعسار ودائني المدين وجمع المعلومات المتعلقة بأعماله وتبويبها وتحليلها للتوصل لأسباب
الإعسار ومدى قابلية أعماله للاستمرار.
ب- مرحلة إعادة التنظيم وهي المرحلة التي تلي المرحلة التمهيدية مباشرة ، ويتم خلالها
التوصل لاتفاق بين المدين ودائنيه على خطة إعادة التنظيم ما لم يقدم طلب تصفية قبل
البدء في هذه المرحلة .
ج- مرحلة التصفية وتخصص لتصفية أموال المدين وتبدأ عند تعذر إعادة التنظيم لعدم إمكانية
استمرار أعمال المدين، أو تعذر الموافقة على خطة إعادة التنظيم أو تعذر تنفيذها بعد الموافقة
عليها .
