Article text
أ- تتوقف آثار إشهار الإعسار بصدور قرار المحكمة بالموافقة على خطة إعادة التنظيم.
ب- مع مراعاة القيود التي تتضمنها الخطة، يسترد المدين كامل صلاحياته في إدارة أمواله
والتصرف فيها، ويعتبر المدين مخلا بالخطة إذا تجاوز هذه القيود.
ج- يجوز أن تنص خطة إعادة التنظيم على تكليف شخص أو لجنة الدائنين بالإشراف على
تنفيذها، و إذا تضمنت الخطة هذا الشرط و لم تعيّن شخصا لذلك فيعتبر وكيل الإعسار حكما
مشرفا على تنفيذ خطة إعادة التنظيم على أن تحدد خطة إعادة التنظيم صلاحيات المشرف
وحقوقه وواجباته وأتعابه.
د- على المشرف على تنفيذ خطة إعادة التنظيم، أو المدين، إذا لم يعيّن مشرفاً، أن يعد تقريرا
سنويا حول سير تنفيذ الخطة ويودعه لدى المحكمة للتشاور مع الدائنين ما لم تنص الخطة على
ميعاد آخر.
هـ- لا يؤثر تعيين وكيل الإعسار مشرفا على تنفيذ خطة إعادة التنظيم على واجباته وفقاً لأحكام
هذا القانون.
