إذا تغيب الزوج وترك زوجته بلا نفقة أو سافر إلى محل قريب أو بعيد أو فقد
يحكم القاضي بنفقتها من يوم الطلب بناءً على البينة التي تقيمها
الـزوجة علـى قيام الزوجية بينهما بعد أن يحلفها اليمين على أن زوجـها لم
يترك لـها نفقـة وأنها ليست ناشزاً ولا علم لها بأنها مطلقة انقضت عدتها.
