جميع احكام هذا الباب التي لم يصرح على وجه خاص بانها مرعية الاجراء على الرغم من كل
اتفاق مخالف او بان عدم رعايتها
موجب للبطلان لا تكون الا بمثابة تأويل لمشيئة المتعاقدين ويجوز مخالفتها بمقتضى نص
صريح.
