Article text
أ- لا يكون البنك المركزي أو أي من مسؤوليه أو موظفيه مسؤولا عن أي إجراء أو فعل أو امتناع
ألحق ضررا بالغير إذا كان ذلك تنفيذاً لمهام ومسؤوليات البنك المركزي وفي حدود صلاحياته
المنصوص عليها في هذا القانون و الأنظمة والتعليمات والقرارات الصادرة بمقتضاه، ويغطي
البنك المركزي أي تكاليف خاصة بمتابعة ذلك لدى أي جهة حتى بعد انتهاء عمل المسؤول أو
الموظف.
ب- لا تطبق أحكام الفقرة (أ) من هذه المادة إذا شكل الإجراء أو الفعل أو الامتناع إهمالا جسيماً
أو كان بسوء نية.
ج- لا يكون المصفي مسؤولا عن أي شيكات يحررها تنفيذا لأعمال التصفية اذا ثبت لديه وجود
رصيد كاف لتغطية تلك الشيكات بتاريخ تحريرها .
