Article text
أ- على المحكمة وخلال مدة خمسة أيام من تاريخ تقديم الاعتراض المنصوص عليه في الفقرة
( )ب( من المادة 11 ) من هذا القانون أن تقرر ما يلي:-
تعيين موعد للنظر في الطلب والاعتراض على أن لا يتجاوز مدة خمسة عشر يوما من تاريخ تقديم
الاعتراض على الطلب .
دعوة المدين والدائنين الذين قدموا طلب إشهار الإعسار للمحاكمة وللمحكمة أن تستمع لأقوال
أي من الخصوم دون حضور الخصم الآخر، إذا رأت ذلك مناسبا.
للمحكمة من تلقاء ذاتها او بناء على طلب أحد الخصوم أن تعين خبيرا أو أكثر لبيان رأيه في
مدى تحقق أسباب إشهار الإعسار.
للمحكمة من تلقاء ذاتها او بناء على طلب أي من الدائنين اتخاذ إجراءات تحفظية للمحافظة
على قيمة أموال الإعسار وحماية حقوق الأطراف جميعهم أو أن تحد من صلاحيات المدين في
ممارسة نشاطه الاقتصادي.
ب- تصدر المحكمة قرارها في الطلب بصفة الاستعجال وفي الأحوال جميعها خلال مدة عشرة
أيام من تاريخ آخر جلسة و خلال مدة خمسة عشر يوما من تاريخ تقديم الاعتراض من المدين في
حال عدم تعيين جلسات.
