Article text
- تنظر المحكمة في طلب إشهار الإعسار تدقيقاً و إذا توافرت الشروط المنصوص عليها في
المواد السابقة كافة تصدر المحكمة قرارا بإشهار الإعسار على أن يتضمن القرار ما يلي:-
المعلومات الشخصية والتجارية الخاصة بأطراف الطلب بما في ذلك موطن كل منهم.
اذا كان الطلب مقدماً من دائني المدين أو المراقب فيجب أن يتضمن القرار إلزام المدين
( بتقديم الوثائق المنصوص عليها في المادة 8 ) من هذا القانون خلال مدة عشرة أيام من
تاريخ صدور قرار إشهار الإعسار.
ج- تحديد صلاحيات المدين في إدارة أمواله والتصرف فيها وإذا قررت المحكمة فرض قيود على
المدين في إدارة ذمة الإعسار أو التصرف فيها فيشتمل القرار على أمر لمديني المدين بسداد أي
التزامات مستحقة للمدين لوكيل الإعسار.
د- تعيين وكيل الإعسار مع بيان اسمه ورقمه الوطني ورقم رخصة المزاولة، وعنوانه للاتصال
والتبليغ وتحديد صلاحياته في إدارة ذمة الإعسار والتصرف فيها.
هـ- أي إجراءات تحفظية تتخذها المحكمة لحماية ذمة الإعسار الى حين تولي وكيل الإعسار
مهامه.
و- دعوة دائني المدين للتقدم بمطالباتهم لوكيل الإعسار خلال مدة ثلاثين يوما من تاريخ نشر
قرار إشهار الإعسار في الجريدة الرسمية وفقاً لأحكام هذا القانــــون.
