Article text
اذا تزامنت إجراءات أجنبية بخصوص المدين ذاته فعلى المحكمة التعاون بموجب أحكام هذا
القانون وتطبيق الأحكام التالية:-
أ- يجب أن لا تتعارض المساعدة الممنوحة لوكيل إعسار أجنبي بموجب أحكام هذا الفصل مع
إجراءات إعسار أجنبية رئيسة بعد الاعتراف بها.
ب- إذا تم الاعتراف بإجراءات إعسار أجنبية ثانوية بعد الاعتراف بإجراءات إعسار أجنبية ثانوية أخرى
أو قدم طلب للاعتراف بها فعلى المحكمة مراجعة أي مساعدة ممنوحه بموجب أحكام هذا
الفصل وتعديلها او الغاؤها إذا كانت لا تتسق مع إجراءات الإعسار الأجنبية الرئيسة.
ج- إذا تم الاعتراف بإجراءات إعسار أجنبية ثانوية بعد الاعتراف بإجراءات ثانوية أخرى، فعلى
المحكمة أن تمنح المساعدة وتعدلها وتنهيها لغايات تسهيل التنسيق بين الإجراءات.
