التنازل
المادة 12 -
إذا كانت العلامة التجاریة تشتمل على مواد شائعة الاستعمال في التجارة او لیست شائعة الاستعمال ولم تكن ذات میزة
ظاھرة
فیجوز للمسجل او لمحكمة العدل العلیا لدى تقریر ما اذا كان یجب تسجیل تلك العلامة التجاریة او ابقاؤھا مسجلة تكلیف
صاحبھا كشرط لبقاء العلامة التجاریة في السجل ان یتنازل عن اي حق في الاستعمال المستقل لجزء او لاجزاء من تلك
العلامة
التجاریة او لجمیع تلك المواد او بقسم منھا مما یرى المسجل او المحكمة انھ لا یملك فیھ حقاً او ان یجري أي تنازل
آخر یراه المسجل او المحكمة ضروریاً لتعیین حقوق صاحب العلامة في ذلك التسجیل على أن لا یؤثر اي تنازل یجریھ
صاحب
العلامة التجاریة في السجل عن اي حق من حقوقھ الا بمقدار ما ینشأ عن تسجیل العلامة التجاریة التي تم التنازل
بشأنھا.
